Woman wins 18m lawsuit

A high court judge has ruled in favour of a property owner who filed a lawsuit against Oceanic Digital, former operators of mobile telephone providers Claro, ordering the company to pay over J$18 million.

Information reaching THE STAR is that the recent ruling was made by High Court judge Bryan Sykes who rejected an application by Oceanic Digital to set aside the J$18 million default judgement entered against the company, in favour of the claimant, Dawn Davis, in 2011.

Davis reportedly filed the lawsuit through her legal team Nigel Jones and company, in which a default judgement was entered last year after Oceanic Digital failed to file a defence.

THE STAR understands the lawsuit was drafted against Oceanic Digital for trespassing on the property of the claimant in Bignum Mountain, St Catherine.

Davis, according to reports, alleges that in 2000, Oceanic Digital cut a road through her property to access one of its cell towers.

A dispute arose as a result of the violation, and the matter was brought to court in 2010.
