Son dupes father out of land ownership

A land dispute between a father and his son is heading for the court because of alleged fraudulent documents presented at a financial institution.

The father complained, last month, that he and his son had borrowed money to buy a lot of land in 2004.

However, unknown to the father, the son borrowed money on the property and did not inform his father.

According to the father, he cannot understand how his son got the loan because he did not sign any document at the financial institution.

"I am very upset with my son, the way he has been treating me, because I have always been kind and considerate to him," the father said.

"A few months ago, I was given notice to quit the premises where I lived for several years. I had no choice but to go and live with my son. He has been treating me very terrible since I moved to the house. If he hears me talking on my cellphone to anyone, he butts in and makes all kinds of remarks.

"I told him to get out of my business, but he tells me that as long as I live with him he was going to be a pest in my life.

"When the land was up for sale, I had a certain amount of money and I gave my son to help to purchase the land for both of us. The money was not enough so we went to a financial institution and borrowed some money to finish paying for the land.

My son subsequently built a house on the land.

After my son began cursing me, I went to the financial institution to enquire about the property, and was told that my name was not on the title.

I enquired and was told that I, along with my son, I had borrowed money to build the house and also submitted a document that I did not have any interest in the property.

"I told them I did not sign any loan agreement to borrow money to build on the property and I did not sign any document that I did not have any interest in the property.

The person who checked the account told me was on the file and the loans have since been paid off.

I am still in shock that a financial institution could lend money to my son on false documents. When I began to query how that could be done, without my knowledge, the employee refused to give me further information.

"My son has cheated me out of the property with the assistance of worker, or workers, at the institution. When I went to get the first loan with my son to buy the land, I had to show my driver's licence as identification, to verify that I was the person borrowing the money. Now I cannot understand how there could be a second loan, I did not sign and did not go in to produce a valid identification.

My sister said my son and the people at that financial institution should be forced to explain how this came about and compensate me for my loss. I think my son and the financial institution should pay me for my portion of the property," he said.

If the financial institution lent your son money without your approval, it would be very negligent because there are certain procedures to be followed before a loan is approved.

You said you had signed no document for the second loan which, you said, was also processed in your name, and you had not signed any document that you did not have an interest in the property.

You should consult a lawyer to write to the financial institution, pointing out the breaches. Ask the lawyer to take the necessary legal steps for you to be compensated.
