Man walks free on wounding charge

Christopher Thomas, STAR Writer

WESTERN BUREAU:

A St James man who reportedly injured another man in September walked out of the Montego Bay Resident Magistrate's Court a free man last Thursday, after the complainant indicated by a written statement, that he would not pursue the case any further.

Fitz-Andrew Hines was previously charged with unlawful wounding, committed against Garfield Cardoza. The case against him was dismissed following a no-evidence ruling by presiding magistrate Carolyn Tie; after the complainant's intentions were revealed to the court.

Although the details of the allegations were not outlined, the court was told that the incident had taken place sometime in September.

Clerk of the court, Reginald England, while reviewing the case, told RM Tie that the complainant, Cardoza, had indicated he would be leaving the island, and that Hines had already compensated him.

"I have a statement from Mr Cardoza, stating that he is leaving the island, he does not know when he is coming back, and he is no longer interested in the matter, and that he has already been compensated by the accused man," said England.

"No evidence is offered - make sure you do not come back before this court for anything else," RM Tie warned Hines, before allowing him to leave the courtroom.
